GENERAL TERMS AND CONDITIONS NUUD

This is how we work: the general delivery terms and conditions of NUUD (the “terms”). These terms apply you place an order with NUUD.
1. General
1.1 NUUD is a registered trademark of NUUD B.V., registered with the Amsterdam Chamber of Commerce under number 69328943. The VAT number is (NL) 857833479B01. NUUD is located at Koningin Wilhelminaplein 1 in AMSTERDAM, the Netherlands.
1.2 Accessibility: you can reach us most easily for all your questions or complaints by email or via Facebook Messenger. Prefer to contact us by phone? Leave your phone number here and we will call you back within 1 working day.
2. Acceptance and your rights as a customer
2.1 These terms apply every time when you place an order with NUUD or authorize NUUD to debit the order amount from your bank account. By placing an order through our website, you expressly you confirm that you have read and accepted these terms before completing your purchase.
2.2 Delivery: NUUD aims to deliver within 24 and 72 hours after ordering and payment. Delivery takes place at the address provided by you during the order process. Delivery times are indicative and not guaranteed. If delivery is delayed or a product is no longer available, we will notify you within thirty (30) days. You may then cancel the order free of charge, and any payments will be refunded.
3. Right of withdrawal
3.1 You have the right to withdraw from the agreement and return your order within fourteen (14) days after delivery without giving any reason. For reasons of health protection and hygiene, this right of withdrawal does not apply to products of which the packaging seal has been broken or opened. To exercise the right of withdrawal, you must inform us (NUUD BV at Koningin Wilhelminaplein 1, 1062 HG in Amsterdam, info@nuud.care) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email) or using the model form attached as an annex to these terms.
3.2 If you wish to return NUUD after receipt, we expect you to handle the packaging with care so that we can receive the products in good condition. The return shipping costs are at your expense.
3.3 We do our utmost to ensure everything goes as expected. If something does not go as expected, we will resolve it as quickly as possible for you. If your order has not arrived correctly, we will send you a replacement package.
3.4 If you have returned NUUD correctly, we will refund the purchase amount as soon as possible, but always within 14 days of confirmation of receipt of the return.
4. Our offer
4.1 Validity: if our offer has a limited validity period or is subject to certain conditions, we always clearly state this in the offer.
4.2 Description: We make every effort to describe and display our products as accurately as possible. However, obvious mistakes or typographical errors in prices or descriptions do not bind us. The offer always includes the total price including VAT and shipping costs), ordering process, payment methods and our contact details.
4.3 The agreement is concluded once you have completed the order process and NUUD has sent a written or electronic confirmation of your order.
5. Prices and payment
5.1 All prices are stated in euros (€), inclusive of VAT and other applicable taxes.
5.2 Payment must be made through the payment methods offered on the website.
5.3 Payment is due prior to shipment, unless otherwise agreed in writing.
6. Privacy
We process your personal data in accordance with our privacy policy and the General Data Protection Regulation (EU) 2016/679 (GDPR). We include your data in our central file. This keeps you informed of new developments regarding NUUD. We always adhere to the rules of the GDPR. We only share personal data with third parties insofar as this is necessary for order fulfilment, payment, delivery, or for limited marketing applications as stated in our privacy policy. You may request access to, correction, or deletion of your personal data at any time by contacting us via the info@nuud.care and removed from marketing emails via the link at the bottom of such emails.
7. Warranty and Liability
7.1 NUUD guarantees that the products we deliver are suitable for the purpose for which they are intended based on the information provided by NUUD and guarantees that the products comply with any legal obligations and other government regulations applicable to us.
7.2 NUUD guarantees that the products and services it provides are produced and/or delivered with respect for people and the environment.
7.3 NUUD is not liable for any damage or injury resulting from incorrect or improper use of the products, including use contrary to the instructions for use, or intended purpose. Our liability does not exclude or limit your rights under statutory product liability or consumer protection law.
7.4 NUUD's liability (other than product liability) is limited to direct damage and the amount of the net invoice value of the product. NUUD is not liable for any form of indirect damage or consequential losses, including lost profits or losses arising from delay or non-delivery.
7.5 Nothing in these terms excludes or limits NUUD’s liability for death or personal injury caused by a product defect or our negligence.
8. Applicable law and competent court
8.1 These terms and any agreement between you and NUUD are exclusively governed by Dutch law, without prejudice to any mandatory consumer protection rights that apply under the law of your country of residence.
8.2 All disputes are exclusively settled by the competent Dutch court, unless mandatory law provides otherwise.
